Barangkali kita pernah mendengar hadits yang menerangkan wanita itu kurang akal dan agamanya. Apa yang dimaksud dengan kalimat tersebut? Apakah itu berarti merendahkan wanita?

Hadits yang kami maksudkan di atas adalah hadits berikut ini,

مَا رَأَيْتُ مِنْ نَاقِصَاتِ عَقْلٍ وَدِينٍ أَغلَبُ لِلُبِّ الرَّجُلِ الْحَازِمِ مِنْ إِحْدَاكُنَّ. فَقِيلَ: يَا رَسُولَ اللهِ، مَا نُقْصَانُ عَقْلِهَا؟ قاَلَ: أَلَيْسَتْ شَهَادَةُ الْمَرْأَتَيْنِ بِشَهَادَةِ رَجُلٍ؟ قِيلَ: يَا رَسُولَ اللهِ، مَا نُقصَانُ دِينِهَا؟ قَالَ: أَلَيْسَتْ إِذَا حَاضَتْ لَمْ تُصَلِّ وَلَمْ تَصُمْ

“Aku tidak pernah melihat orang yang kurang akal dan agamanya paling bisa mengalahkan akal lelaki yang kokoh daripada salah seorang kalian (kaum wanita).” Maka ada yang bertanya, “Wahai Rasulullah, apa maksudnya kurang akalnya wanita?” Beliau menjawab, “Bukankah persaksian dua orang wanita sama dengan persaksian seorang lelaki?” Ditanyakan lagi, “Ya Rasulullah, apa maksudnya wanita kurang agamanya?” "Bukankah bila si wanita haid ia tidak shalat dan tidak pula puasa?”, jawab beliau. (Muttafaqun ‘alaih, HR. Bukhari no. 1462 dan Muslim no. 79)

Mengenai maksud hadits di atas diterangkan oleh Syaikh ‘Abdul Kairm Khudair, ulama senior di kota Riyadh Saudi Arabia dan saat ini menjadi pengajar di Jami’ah Malik Su’ud (King Saud University Riyadh). Beliau ditanya, “Apa maksud kurang akal dan agamanya bagi wanita sebagaimana disebutkan dalam hadits ‘wanita itu kurang akal dan agama’?”

Syaikh hafizhohullah menjawab,

Tafsir tentang makna kurang akal dan agama telah diterangkan dalam hadits muttafaqun ‘alaih (riwayat Bukhari-Muslim). Bahwa yang dimaksud kurang akal adalah karena persaksian wanita itu separuh dari persaksian laki-laki sebagaimana disebutkan dalam ayat,

فَإِنْ لَمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَامْرَأَتَانِ

“Jika tak ada dua oang lelaki, maka (boleh) seorang lelaki dan dua orang perempuan” (QS. Al Baqarah: 282). Inilah yang dimaksud wanita itu kurang akal.

Sedangkan yang dimaksud wanita itu kurang agama adalah karena pada satu waktu (yaitu kala haidh atau nifas, pen), wanita tidak puasa dan tidak shalat. Inilah tafsir yang langsung diterangkan oleh Nabi shallallahu ‘alaihi wa sallam (secara marfu’) dan bukan hasil ijtihad seorang pun. Adapun kondisi wanita di mana mereka berada pada kondisi separuh dari pria adalah dalam lima keadaan, yaitu dalam persaksian, diyat, warisan, aqiqah, pembebasan budak –yaitu siapa yang memerdekakan dua orang budak wanita sama dengan memerdekakan seorang budak laki-laki. Dalam hadits disebutkan, “Barangsiapa yang memerdekakan seorang budak laki-laki, maka ia akan selamat dari siksa neraka. Barangsiapa yang memerdekakan dua budak wanita, maka ia akan selamat dari siksa neraka.”

Semoga dengan penjelasan ini semakin jelas apa yang dimaksud wanita kurang akal dan agamanya. Semoga dengan benar memahami hal ini tidak menyebabkan kita merendahkan wanita. Karena kenyataannya pula banyak wanita yang mengungguli pria dalam hal kecerdasan dan memahami agama.

Engkau ini tidak adil – berbeda dengan orang-orang Kristen yang penuh dengan keadilan!”

Ia meneruskan dengan mengatakan bahwa ajaran-ajaran seperti itu (ajaran Kristen) sepenuhnya berkontradiksi dengan “agama Nabi” (Muhammad), yang tentu saja memiliki banyak isteri – lebih dari yang ditentukan oleh Quran, yaitu 4 orang isteri – membuat perceraian menjadi hal sederhana bagi kaum pria, dan menetapkan bahwa kaum wanita hanya mewarisi separuh dari warisan yang diterima kaum pria.

Ulama itu memprotes bahwa, berdasarkan ajaran Kristen seperti itu, pria Muslim yang coba menerapkan hak-hak Islami mereka – termasuk poligami, warisan dua kali lebih besar, dan kemudahan dalam bercerai (contoh-contoh terkini termasuk perceraian yang dilakukan hanya lewat SMS) – menjadi sesuatu yang dianggap sebagai “kriminalitas, dan agama Islam yang mengajarkan hal-hal itu akan dianggap sebagai mengajarkan kejahatan kepada mereka.”

Sang ulama menyimpulkan dengan mengatakan bahwa, tidak diijinkan “untuk memproduksi teks-teks yang berkontradiksi dengan Quran, atau dengan praktik-praktik membesarkan anak yang sudah kita jalankan selama satu juta tahun [sebuah bahasa kiasan: Padahal Islam baru ada kurang dari 1400 tahun lalu].

To understand why a society like Egypt, political groups like the Muslim Brotherhood and Islamic clerics are oppressing women in a manner that appears totally acceptable to them, you must visit the teaching of their prophet Mohammed. Below are a sample of Islamic teachings attributed to Mohammed, to the non Muslim they are vulgar, outrageous, demeaning and explain why Islamic men feel they must “control and regulate” everything their women do.

Mohammed's teachings are included in what is called "Hadith." Women are deficient in mind and religion.

o Mohammed asked some women, "Isn't the witness of a woman equal to half that of a man?" The women said, "yes,"He said, "This is because of the deficiency of the woman's mind. " Vol. 3:826

o Mohammed to women: "I have not seen any one moredeficient in intelligence and religion than you." Vol. 2:541

The majority of people in hell are women.

o Mohammed said, "I was shown the Hell-fire and that the majority of its dwellers are women. " Vol. 1:28, 301; Vol. 2:161; Vol. 7:124

Women are a bad omen.

o Mohammed said, " Bad omen is in the woman, the house and the horse." Vol. 7:30

Women are harmful to men.

o Mohammed said, "After me I have not left any affliction more harmful to men than women." Vol. 7:33

Women may not wear wigs.

o Mohammed said, "Don't wear false hair for Allah sends His curse upon such ladies who lengthen their hair artificially."Vol. 7:133
2. The Primary role of women is SEX

Mohammed's sexual strength is equal to 30 men.

Anas said, "The prophet used to visit all his wives in an hour round, during the day and night and they were eleven in number." I asked Anas, "Had the prophet the strength for it?" Anas replied, "We used to say that the prophet was given the strength of thirty (men). " Vol. 1:268

Mohammed married a 9 year old girl.

o "Narrated Aisha that the prophet married her when she was six years old and he consummated his marriage when she was nine years old."Vol. 7:64

Allah hurries to please Mohammed's sexual desires.

o When the Quranic verse that allows Mohammed to postpone the turn of any wife was revealed, and when Mohammed said that Allah allowed him to marry his adopted son's wife, Aisha (one of his wives) told him, "O Allah's Apostle I do not see but that your Lord hurries in pleasing you. " Vol. 7:48

When a woman is divorced, she can not return to her husband until she marries and has sexual intercourse with another man.

o "Narrated Aisha: The wife of Rifaa Al-Qurazi came to Allah's Apostle and said, 'O Allah's Apostle, Rifaa divorced me irrevocably. After him I married Abdur-Rahman bin Az-Zubair Al-Qurazi who proved to be impotent.' Allah's Apostle said to her, 'Perhaps you want to return to Rifaa? Nay (You cannot return to Rifaa) until you and Abdur-Rahman (the impotent man) engage in sexual intercourse!" Vol. 7:186

Ia meneruskan dengan mengatakan bahwa ajaran-ajaran seperti itu (ajaran Kristen) sepenuhnya berkontradiksi dengan “agama Nabi” (Muhammad), yang tentu saja memiliki banyak isteri – lebih dari yang ditentukan oleh Quran, yaitu 4 orang isteri – membuat perceraian menjadi hal sederhana bagi kaum pria, dan menetapkan bahwa kaum wanita hanya mewarisi separuh dari warisan yang diterima kaum pria.

Ulama itu memprotes bahwa, berdasarkan ajaran Kristen seperti itu, pria Muslim yang coba menerapkan hak-hak Islami mereka – termasuk poligami, warisan dua kali lebih besar, dan kemudahan dalam bercerai (contoh-contoh terkini termasuk perceraian yang dilakukan hanya lewat SMS) – menjadi sesuatu yang dianggap sebagai “kriminalitas, dan agama Islam yang mengajarkan hal-hal itu akan dianggap sebagai mengajarkan kejahatan kepada mereka.”

The oppression of women is intrenched in Saudi religious tradition, and subsequently governance. The mistreatment of women within a society has consequences extending far beyond women themselves. When arrested, homosexuals are often charged with, “behaving like women.” Clearly the oppression of women is a contributing factor to the oppression of other groups.
Sharia Law and the Oppression of Women

No matter their social class, ethnicity, or religious group, Islamic women are treated as property by the males in their lives. Under Sharia Law, also known as Islamic law, many women are killed in the name of “family honor.” In several Islamic countries they believe that the women have a very important role in upholding the family’s reputation. There are many different offenses committed by the women that bring about these “honor killings.” “Marital infidelity, pre-marital sex, flirting, or even failing to serve a meal on time can all be perceived as impugning the family honor.” (Mayell 2) In the Islamic society most marriages are arranged by the fathers and there is an exchange of money that goes along with it. If the women express any desire to choose their own husband they would view this as a punishable offense. This can be viewed as a major act of defiance that damages the honor of the man who negotiated the deal. (Mayell 2)

“The teenage brothers of victims are frequently directed to commit the murder because, as minors, they would be subject to considerably lighter sentencing if there is legal action. Typically, they would serve only three months to a year.” (Mayell 2)

One very important thing that contributes to the continued mistreatment of women in the Islamic culture is the fact that other women in the family go along with and encourage this way of life. It is suggested that violence against women is not a judicial issue, but rather a family issue. (Mayell 1) It is widely stated said that there is nothing to be done about the tradition of “honor killings” due to the fact that the concept of women’s rights is not relevant to the Islamic societies.

Islam memuliakan wanita dengan cara menempatkan wanita pada kodratnya...

Bangsa barat dalam reformasi dan modernisasi, menuntut persamaan hak (emansipasi). Namun, konsep emansipasi itu sendiri yang semakin lama semakin tidak jelas, yang seharusnya emansipasi membebaskan wanita dari belenggu perbudakan, tetapi malah menjerumuskan wanita ke jurang perbudakan yang baru.

Pada masyarakat kapitalis, wanita dieksploitasi dan menjadi komoditas yang dapat di perjual belikan kepada umum, lihat saja tayangan iklan-iklan di media informasi di sekeliling kita.

Di dalam masyarakat yang bebas, wanita di didik budaya permisif yang lepas dari nilai-nilai normatif hanya untuk kepentingan industri. Di luar konsep Islam mereka menuntut kesamaan, kebebasan dan hak asasi manusia, padahal mereka malah mengabaikkan kodrat dan martabat wanita yang seharusnya dijunjung tinggi. Secara tidak langsung mereka menganggap bahwa Islam bersikap diskriminasi terhadap wanita. Padahal Islam menempatkan wanita tidak melebihi atas apa yang telah di gariskan dan dikodratkan sebagai wanita.

Umar bin Khathab pernah berkata, "Pada masa jahiliyah, wanita itu tak ada harganya bagi kami. Sampai akhirnya Islam datang dan menyatakan bahwa wanita itu sederajat dengan laki-laki."
