konsep islam tentang kesetaraan gender dan tafsir Wanita "setengah" Akal
First topic message reminder :
Barangkali kita pernah mendengar hadits yang menerangkan wanita itu kurang akal dan agamanya. Apa yang dimaksud dengan kalimat tersebut? Apakah itu berarti merendahkan wanita?
Hadits yang kami maksudkan di atas adalah hadits berikut ini,
مَا رَأَيْتُ مِنْ نَاقِصَاتِ عَقْلٍ وَدِينٍ أَغلَبُ لِلُبِّ الرَّجُلِ الْحَازِمِ مِنْ إِحْدَاكُنَّ. فَقِيلَ: يَا رَسُولَ اللهِ، مَا نُقْصَانُ عَقْلِهَا؟ قاَلَ: أَلَيْسَتْ شَهَادَةُ الْمَرْأَتَيْنِ بِشَهَادَةِ رَجُلٍ؟ قِيلَ: يَا رَسُولَ اللهِ، مَا نُقصَانُ دِينِهَا؟ قَالَ: أَلَيْسَتْ إِذَا حَاضَتْ لَمْ تُصَلِّ وَلَمْ تَصُمْ
“Aku tidak pernah melihat orang yang kurang akal dan agamanya paling bisa mengalahkan akal lelaki yang kokoh daripada salah seorang kalian (kaum wanita).” Maka ada yang bertanya, “Wahai Rasulullah, apa maksudnya kurang akalnya wanita?” Beliau menjawab, “Bukankah persaksian dua orang wanita sama dengan persaksian seorang lelaki?” Ditanyakan lagi, “Ya Rasulullah, apa maksudnya wanita kurang agamanya?” "Bukankah bila si wanita haid ia tidak shalat dan tidak pula puasa?”, jawab beliau. (Muttafaqun ‘alaih, HR. Bukhari no. 1462 dan Muslim no. 79)
Mengenai maksud hadits di atas diterangkan oleh Syaikh ‘Abdul Kairm Khudair, ulama senior di kota Riyadh Saudi Arabia dan saat ini menjadi pengajar di Jami’ah Malik Su’ud (King Saud University Riyadh). Beliau ditanya, “Apa maksud kurang akal dan agamanya bagi wanita sebagaimana disebutkan dalam hadits ‘wanita itu kurang akal dan agama’?”
Syaikh hafizhohullah menjawab,
Tafsir tentang makna kurang akal dan agama telah diterangkan dalam hadits muttafaqun ‘alaih (riwayat Bukhari-Muslim). Bahwa yang dimaksud kurang akal adalah karena persaksian wanita itu separuh dari persaksian laki-laki sebagaimana disebutkan dalam ayat,
فَإِنْ لَمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَامْرَأَتَانِ
“Jika tak ada dua oang lelaki, maka (boleh) seorang lelaki dan dua orang perempuan” (QS. Al Baqarah: 282). Inilah yang dimaksud wanita itu kurang akal.
Sedangkan yang dimaksud wanita itu kurang agama adalah karena pada satu waktu (yaitu kala haidh atau nifas, pen), wanita tidak puasa dan tidak shalat. Inilah tafsir yang langsung diterangkan oleh Nabi shallallahu ‘alaihi wa sallam (secara marfu’) dan bukan hasil ijtihad seorang pun. Adapun kondisi wanita di mana mereka berada pada kondisi separuh dari pria adalah dalam lima keadaan, yaitu dalam persaksian, diyat, warisan, aqiqah, pembebasan budak –yaitu siapa yang memerdekakan dua orang budak wanita sama dengan memerdekakan seorang budak laki-laki. Dalam hadits disebutkan, “Barangsiapa yang memerdekakan seorang budak laki-laki, maka ia akan selamat dari siksa neraka. Barangsiapa yang memerdekakan dua budak wanita, maka ia akan selamat dari siksa neraka.”
Semoga dengan penjelasan ini semakin jelas apa yang dimaksud wanita kurang akal dan agamanya. Semoga dengan benar memahami hal ini tidak menyebabkan kita merendahkan wanita. Karena kenyataannya pula banyak wanita yang mengungguli pria dalam hal kecerdasan dan memahami agama.

kesetaraan gender selalu jadi isu utama non muslim untuk menyerang islam..
tak perlu berkata emansipasi dll dsb
hukum alam saja sudah membuktikan bahwa kesetaraan pria dan wanita tidak bisa dibandingkan apple to apple...
wanita punya tempatnya sendiri untuk menjadi mulia begitupun pria dimata islam...
salahkah islam menempatkan wanita pada kodratnya???
seorang pria pemimpin sebuah negara belum tentu lebih mulia dari seorang ibu yang mendidik anaknya dengan baik...
lihat efek negatifnya jika konsep emansipasi berkembang secara global akan banyak manusia yg kehilangan kasih ibunya...padahal pendidikan anak dimulai dari kasih sayang seorang ibu...

ibu yg terkenal, berkuasa, tapi kurang kasih sayang terhadap anda sbg anaknya
atau ibu yg setiap pagi membuatkan anda sarapan, cemas atas kepulangan anda dan mendekap anda ketika sakit???

Kalau Forum seperti FFI yg melarang keras link / sumber dari forum Laskar Islam atau forum2 ISlam lainnya, apa yg ditakuti mereka sih volt?

Setahu saya, Saya tidak pernah tahu adanya peraturan yg demikian mencekik bagi terpidana seumur-umur saya membaca sirah, kisah Nabi dan para khulaful Rasyidin.
YA saya tahu, Ketakutan muslim menjadi murtad adalah alasan dilarangnya menampilkan link forum anti Islam di forum ini

One very important thing that contributes to the continued mistreatment of women in the Islamic culture is the fact that other women in the family go along with and encourage this way of life. It is suggested that violence against women is not a judicial issue, but rather a family issue. (Mayell 1) It is widely stated said that there is nothing to be done about the tradition of “honor killings” due to the fact that the concept of women’s rights is not relevant to the Islamic societies.

Lah BUKTINYA mereka TELAH DENGAN TEGAS MENYATAKAN HAL ITU, DAN ALQURAN ADALAH SANDARAN/DASAR HUKUM MEREKA.

Kenyataannya kan sudah saya bilang, banyak yg munafik, pernyataan saya memang tidak bisa mengubah apa-apa..
Sm saja seperti anda, teriak anda disinipun tidak akan mengubah apa2, kecuali kita diskusi saling mempertahankan pendapat dan argument dengan cerdas, bukan lempar tanggung jawab saya harus mendebat pemerintah Arab Saudi kan?

Egypt's Muslim Brotherhood have claimed that a UN declaration calling for an end to violence against women will lead to the "complete disintegration of society".
Delegates at the UN's Commission on the Status of Women (CSW) in New York have spent the last fortnight debating the wording of a declaration that would condemn violence against women. The brotherhood, whose close allies control Egypt's parliament and presidency, slated the declaration in an online statement on Thursday – calling it a decadent and destructive document that undermined Islamic ethics by calling for women to work, travel and use contraception without their husbands' permission.
In a 10-point memorandum, the brotherhood also criticised the declaration for granting women sexual freedom, allowing Muslim women to marry non-Muslims, granting equal rights to homosexual people, and allowing wives full legal rights to take their husbands to court for marital rape.
"This declaration, if ratified, would lead to complete disintegration of society, and would certainly be the final step in the intellectual and cultural invasion of Muslim countries, eliminating the moral specificity that helps preserve cohesion of Islamic societies," the brotherhood 's statement claimed.
The remarks drew a furious response inside Egypt. Soad Shalaby, a spokesperson for Egypt's National Council for Women, said: "How would this declaration lead to a disintegration of society? On the contrary, it will lead to women's integration within society."
Shalaby said it was disingenuous to use Islam to justify the erosion of women's rights. "It is only a misinterpretation of Islam that creates these kinds of statements," she said. "It goes without saying that Islam never encourages violence against women. On the contrary, it gives them rights." She said she thought the brotherhood's outburst was not a fair reflection of the views of many within the Muslim Sisterhood, the brotherhood's female division – let alone the Middle East.
"We're asking them to stop using religion and culture to undermine negotiations and to justify violence against women," said Lynn Darwich, a spokesperson for the Coalition for Sexual and Bodily Rights in Muslim Societies, who is attending the conference in New York.
The brotherhood's statement is also likely to have divided Egypt's delegation at the Commission on the Status of Women, which contains both conservative and liberal members. "On the whole, they have been quiet because of internal divisions within the delegation," said Darwich.
The brotherhood is not the only group to have voiced objections to the UN charter, which has been the subject of bitter debate. Countries such as the Vatican, Pakistan, Iran, Syria and Russia have led the conservative response.
A spokesman for Mohamed Morsi, Egypt's Islamist president who comes from the political wing of the Muslim Brotherhood, attempted to distance himself from the brotherhood's statement, saying he was no longer a member of the organisation. But in an interview with the New York Times, Pakinam al-Sharkawy also appeared to side with some of the brotherhood's arguments, claiming that marital rape was a western rather than Egyptian problem.
Darwich said her remarks showed the Egyptian government was still failing to take women's rights seriously. "This denial that these issues are not ours will make the situation worse," she said. "We need Arab governments to recognise that these are not foreign issues."
Women rights are the subject of an continuing national debate in Egypt: at least 25 women were sexually assaulted in Tahrir Square during recent protests – in what some campaigners claim is a systematic attempt to stop women from protesting.
But the problem goes far beyond Tahrir Square.
According to a 2008 survey by the Egyptian Center for Women's Rights, 83% of Egyptian women have been sexually harassed in their lifetime – while the assault of street children goes widely unreported. Female genital mutilation was banned in 2008, but according to some surveys, up to 90% of Egyptian women may have been subjected to the practice.
The fall of Hosni Mubarak two years ago was supposed to be a turning point for women's rights – but for many campaigners, Egypt has since regressed. The country's new constitution does not safeguard the rights of women, while a quota for women in parliament has been rescinded, meaning that just 2% of MPs elected in 2012 were female – down from 12% in 2010.
"There is a trend that limits the role of women," said Shalaby. "They are trying to make us lose whatever gains we got from the revolution."

UNITED NATIONS, March 14 (Reuters) - Egypt's ruling Muslim Brotherhood warns that a U.N. declaration on women's rights could destroy society by allowing a woman to travel, work and use contraception without her husband's approval and letting her control family spending.
The Islamist party of President Mohamed Mursi outlined 10 reasons why Muslim countries should "reject and condemn" the declaration, which the U.N. Commission on the Status of Women is racing to negotiate a consensus deal on by Friday.
The Brotherhood, which was elected to power in June, posted the statement on its website, www.ikhwanweb.com, on Thursday.
Egypt has joined Iran, Russia and the Vatican - dubbed an "unholy alliance" by some diplomats - in threatening to derail the women's rights declaration by objecting to language on sexual, reproductive and gay rights.
The Muslim Brotherhood said the declaration would give "wives full rights to file legal complaints against husbands accusing them of rape or sexual harassment, obliging competent authorities to deal husbands punishments similar to those prescribed for raping or sexually harassing a stranger."
U.S. Ambassador Susan Rice last week touted at the commission - a global policy-making body created in 1946 for the advancement of women - progress made by the United States in reducing the rate of violence against women by their partners.
"All 50 states in our union now have laws that treat date rape or spousal rape as just as much of a crime as rape by a stranger," Rice said. "We cannot live in truly free societies, if women and girls are not free to reach their full potential."
The contrasting views show the gap that needs to be breached in negotiations on the declaration, which this year is focused on urging an end to violence against women and girls. The commission failed to agree a declaration last year on a theme of empowering rural women due to similar disagreements.
WORLD IS WATCHING
Egypt has proposed an amendment, diplomats say, that would allow countries to avoid implementing the declaration if it clashed with national laws, religious or cultural values. But some diplomats say this would undermine the entire declaration.
The Muslim Brotherhood warned the declaration would give girls sexual freedom, legalize abortion, provide teenagers with contraceptives, give equality to women in marriage and require men and women to share duties such as child care and chores.
It said the declaration would allow "equal rights to homosexuals, and provide protection and respect for prostitutes" and "equal rights to adulterous wives and illegitimate sons resulting from adulterous relationships."
A coalition of Arab human rights groups - from Egypt, Lebanon, the Palestinian Territories, Jordan and Tunisia - called on countries at the Commission on the Status of Women on Thursday to stop using religion, culture, and tradition to justify abuse of women.
"The current positions taken by some Arab governments at this meeting is clearly not representative of civil society views, aspirations or best practices regarding the elimination and prevention of violence against women and girls within our countries," said the statement issued by the Coalition for Sexual and Bodily Rights in Muslim Societies.
Michelle Bachelet, a former president of Chile and head of U.N. Women, which supports the commission, said the commission was unable to reach a deal a decade ago when it last focused on the theme of women's rights and ending violence against women.
"Ten years later, we simply cannot allow disagreement or indecision to block progress for the world's women," Bachelet told the opening session of the commission last week. "The world is watching ... the violence needs to stop." (Editing by Mohammad Zargham)
